Tekelec’s Compliance with the RoHS Directive

Effective July 1, 2006, Tekelec will comply with the European Union (EU) Restriction of Hazardous Substance (RoHS) Directive (2002/95/EC) for products distributed in the EU. The company’s compliance is based on the RoHS directive issued by the EU and not on any specific member-state legislation or legislation from any specific country.

Tekelec will eliminate all banned substances except lead-based solder. Lead-based solder is one substance for which an exemption has been provided for the telecom industry. It is expected that acceptable alternatives to lead-based solder will be available in the future, but the current options pose manufacturing risks that could impact product reliability.

Tekelec does not intend to label its products as RoHS compliant. Such labeling is not required by the Directive, and no industry or regulatory standard exists for the labeling.

Tekelec may continue to use non-RoHS compliant equipment for the purpose of capacity expansion and/or upgrades for equipment that is shipped prior to July 1, 2006. Any expansions required for equipment shipped after July 1, 2006, will be RoHS compliant.

As other environmental regulations are passed by countries in which Tekelec conducts business, the company will respond with the appropriate compliance.

Tekelec’s Compliance with the WEEE Directive
Tekelec will fully comply with the disposal/recycling portion of the EU’s Waste Electrical and Electronic Equipment (WEEE) Directive (2002/96/EC). All Tekelec equipment sold in the EU will bear the WEEE label, indicating that the products should not be disposed of in an EU landfill. Tekelec will provide its EU customers with a return and collection policy for products that have been decommissioned due to operational end-of-life.
